GENERAL CONDITIONS

User: the owner of the apartments of Finca La Vida Loca
Other Party: the guests who enter into a rental agreement with Finca La Vida Loca.

The owner of the Finca La Vida Loca can be replaced by a (temporary) representative.

DOMESTIC REGULATIONS

• The apartment is described on the website fincalavidaloca.com This website is compiled with the greatest care but there may be differences between the text and/or photos presented on the website and the actual situation in and around the apartments at the time of the visit by the guest(s). No rights can be derived by guests from such differences.
• The minimum stay in an apartment is 2 nights.
• The apartments are accessible 24 hours a day. The apartments each have a private entrance
• The use of the apartments by third parties is prohibited. Visitors are not allowed to stay overnight in the apartments without the user’s permission and without additional payment.
• The apartment should be in clean condition upon departure. Before commencement
  a recording state is created by the user. If the room at
  departure differs from the recording state in such a way that the user can use the additional
  charge replacement or cleaning costs to the other party.
• Garbage should be deposited in the designated container.
• Smoking is not allowed in the apartment. Smoking is allowed outside, however.
• Small pets are not allowed.
• Barbecuing is not allowed on the private terrace.
• Consumption of self-brought drinks and food is not allowed in the public areas.
• Check-in is possible from 3 p.m. until 11 p.m. at the latest. Check-out is available until 11:00 a.m. at the latest. These times can be adjusted after mutual agreement.
• The other party can park the car in the parking spaces available on the premises. Parking is at your own risk.
• All risks related to staying in or around the apartments as well as in or around the pool are the responsibility of the other party.
• Damage respectively loss of (un)movable property owned by the user shall be reported and shall be compensated to the user
• The other party must follow the user’s instructions.
• After 11 p.m., you should not cause noise both inside and outside your apartment.
• The user may deny and/or refuse the other party access to the apartment complex with immediate effect in case of inappropriate behavior, without further notice and indication of reasons and without refund of accommodation expenses.

RATES

• Rates include water, VAT, bed linen, towels and final cleaning.
• When booking apartment El Gecko Grande for less than 3 days, 40,- euro final cleaning is due.
• Rates do not include the cost of cancellation and/or travel insurance and/or other charges.
• Apartment rates are always without obligation and are subject to interim changes.
• All entries on the Finca La Vida Loca website are considered to be provided in good faith and are always subject to interim changes. Finca La Vida Loca is not bound by obvious errors on its website.
• Offers never apply in conjunction with other offers.

RESERVATION AND PAYMENT

• On our site you can indicate a preference for the desired accommodation(s).
• Upon receipt of your reservation request, we will contact you within 24 hours.
• Your reservation is final only when a deposit of 50% of the total amount of the stay is paid into our account within 10 days of receiving our notice.
• Upon receipt of the deposit, we finalize the reservation with a confirmation and your reservation is therefore final.
• After a reservation is confirmed through an affiliated third party, a rental agreement is also established.
  There is no additional reservation fee.
• Remaining lodging fees must be paid upon arrival at the accommodation.
• Payments are made by bank transfer or credit card.

CANCELLATION

• Cancellation must always be made in writing via email info@fincalavidaloca.com to Finca La Vida Loca.
• If you cancel more than 1 month before the effective date of your reservation, we will refund the full deposit to your account.
• Should Finca La Vida Loca for any reason not be able to rent out the reserved room, another apartment or similar accommodation will be offered by mutual agreement.

COMPLAINTS

• The other party is always entitled to submit its grievances to Finca La Vida Loca through a complaint. The latter shall always deal with a complaint adequately and expeditiously, such that the complaint is dealt with according to standards of reasonableness and fairness.
• In cases of force majeure, whether permanent or temporary, Finca La Vida Loca shall be entitled to cancel or temporarily suspend all or part of the agreement without the guest being able to claim fulfillment and/or compensation. Force majeure includes, but is not limited to: danger of war, war, insurrection, acts of war, strikes, boycotts, disturbances in the energy circuit, in traffic or transport, governmental measures, scarcity of raw materials, natural disasters and furthermore all circumstances, extraordinary weather conditions, death of one of the owners or close relatives, etc. under which full or partial fulfillment of the contract cannot be reasonably and fairly expected from Finca La Vida Loca.

LIABILITY

• Finca La Vida Loca cannot be held liable for any damage suffered by the other party or third parties as a result of the stay in the accommodation.
• Finca La Vida Loca is not liable for disturbances in and around the accommodation such as failures and breakdowns of power and water supplies and technical installations, construction and/or road works in the vicinity of the apartment complex that have not been announced or have been announced in time.
• Finca La Vida Loca can only be held liable for damages due to the gross fault or negligence of the aforementioned.
• Finca La Vida Loca is an Adults Only accommodation.
• Should such a problem occur, it is always limited to direct damage and any form of consequential damage is excluded. Furthermore, Finca La Vida Loca’s liability shall be limited to the maximum amount that Finca La Vida Loca’s insurer will pay in the appropriate case.

PRIVACY

• Finca La Vida Loca will keep all personal data provided to it or made known to it confidential and will not make it freely available to third parties.
